In recent years, the federal government and several state governments have attempted to change the definition of the legal holiday to distinguish it from other days recognized throughout the year. For example, some States have opted to recognize January as the start of “Indian Summer” instead of the traditional start of the Common School calendar. Although the Constitution does not explicitly mention the date of the holiday, historians believe that it was probably chosen to coincide with the second week of the April holiday known as Lent. Historians speculate that Benjamin Franklin, the first British representative to the Continental Congress, may have been the first to decide that the fourth Thursday of April would be a holiday designated for Americans. Franklin made this announcement in a letter to the House of Representatives on the eve of his return to America from England. The resolution was not passed out of the House in that session but was reintroduced later that year.

Today, most states observe a federal holiday dedicated to the Constitution. Several states also celebrate the beginning of another, longer weekend, known as” Presidents’ Day,” on the first Sunday in February. In many states, local communities also choose to celebrate the anniversary of the Constitution, which is commemorated in different ways. For example, municipalities that celebrate May Day or Veterans Day use the same criteria to select their Constitution Day activities as other states.
